Lacson Backs DOE-Mandated Fuel Adjustments, Stresses Fair Pricing

Senate President Pro Tempore Panfilo “Ping” M. Lacson on Tuesday backed the Department of Energy (DOE)’s move to mandate fuel price adjustments, provided these remain reasonable.

Lacson said such intervention – enabled by the DOE’s authority to impose price adjustment limits during a state of national energy emergency – is far better than leaving the fuel prices to the oil firms.

“Dapat lang gamitin ng pamahalaan ang pagdeklara ng state of national energy emergency. As long as reasonable ang gagawing computation ng DOE sa pag-adjust ng presyo – pagbaba man or pagtaas ng presyo ng pump prices, mas makakabuti sa mas nakakaraming Pilipino ang ganitong patakaran o polisiya kesa naman ipaubaya sa oil companies ang pagtatalaga ng presyo (The government must use the powers granted to it under a state of national energy emergency. As long as the DOE’s computations are reasonable – whether the adjustments are upward or downward – this is better than just allowing oil firms to dictate prices of fuel),” he said.

For this week, the DOE set a minimum rollback of P24.94 per liter for diesel, P3.41 for gasoline, and P2.00 for kerosene. DOE Secretary Sharon Garin was quoted as saying that companies are free to offer bigger discounts, but  any adjustment less than the prescribed amount will trigger legal action.

Also, DOE Oil Industry Management Bureau director Rino Abad was quoted as saying violators will be charged under Section 24 of the Downstream Oil Industry Deregulation Act of 1998, with penalties including three months to one year imprisonment and a fine ranging from P50,000 to P300,000.

The DOE also warned it may revisit or revoke the business permits of any firm that resists the prescribed price ceiling.

Lacson pointed out that Republic Act 8479, or the Downstream Oil Industry Deregulation Act, allows the DOE to take over temporarily or direct the operation of any person or entity in the oil industry.

“Kung tutuusin, binibigyan pa nga ng karapatan ang estado sa ilalim ng RA 8479 or Downstream Oil Industry Deregulation Act (Under RA 8479 or the Downstream Oil Industry Deregulation Act), to quote – ‘when public interest so requires, the DOE may, during the period of the emergency and under reasonable terms prescribed by it, temporarily take over or direct the operation of any person or entity engaged in the industry,’” he said.

Sinuportahan ni Senate President Pro Tempore Panfilo “Ping” M. Lacson nitong Martes ang hakbang ng Department of Energy (DOE) na magtakda ng fuel price adjustments, basta’t nananatiling makatarungan ang mga ito.

Ani Lacson, ang ganitong interbensyon — na pinahihintulutan ng kapangyarihan ng DOE na magtakda ng limitasyon sa price adjustments sa ilalim ng state of national energy emergency — ay mas mainam kaysa ipaubaya lamang sa mga oil firm ang pagtatakda ng presyo ng langis.

“Dapat lang gamitin ng pamahalaan ang pagdeklara ng state of national energy emergency. As long as reasonable ang gagawing computation ng DOE sa pag-adjust ng presyo – pagbaba man or pagtaas ng presyo ng pump prices, mas makakabuti sa mas nakakaraming Pilipino ang ganitong patakaran o polisiya kesa naman ipaubaya sa oil companies ang pagtatalaga ng presyo,” giit ng mambabatas.

Para sa linggong ito, nagtakda ang DOE ng minimum rollback na P24.94 kada litro para sa diesel, P3.41 para sa gasolina, at P2.00 para sa kerosene. Ayon kay DOE Secretary Sharon Garin, malaya ang mga kumpanya na magbigay ng mas malalaking diskwento, ngunit anumang adjustment na mas mababa sa itinakdang halaga ay magreresulta sa legal na aksyon.

Dagdag ni DOE Oil Industry Management Bureau director Rino Abad, ang mga lalabag ay kakasuhan sa ilalim ng Section 24 ng Downstream Oil Industry Deregulation Act of 1998, na may parusang pagkakakulong mula tatlong buwan hanggang isang taon at multang mula P50,000 hanggang P300,000.

Nagbabala rin ang DOE na maaari nitong repasuhin o bawiin ang business permits ng kumpanyang lalabag o hindi susunod sa itinakdang price ceiling.

Samantala, binigyang-diin naman ni Lacson na pinahihintulutan ng Republic Act 8479 o ang Downstream Oil Industry Deregulation Act ang DOE na pansamantalang akuin o direktang pamahalaan ang operasyon ng sinumang tao o entidad sa industriya ng langis.

“Kung tutuusin, binibigyan pa nga ng karapatan ang estado sa ilalim ng RA 8479 or Downstream Oil Industry Deregulation Act, to quote – ‘when public interest so requires, the DOE may, during the period of the emergency and under reasonable terms prescribed by it, temporarily take over or direct the operation of any person or entity engaged in the industry,’” aniya.
